Terms of Service (Subscription)


Introduction

Welcome to Ezease ("we", "our", or "us"). These Terms and Conditions ("Terms") govern your purchase and use of our subscription plans and design services ("Services"). By purchasing a subscription plan or placing an order, you agree to comply with and be bound by these Terms.

Services

  • Description: We offer a variety of design services and subscription plans as detailed on our website.

  • Customization: Each subscription plan includes a set number of hours for design services as specified in the plan details.

  • Limitations: Ezease will not engage in projects related to political campaigns. However, we are committed to supporting social causes that benefit humanity.

Subscription Plans

  • Tier 1 EZ-Knight: 40 hours per month.

  • Tier 2 EZ-Master: 80 hours per month.

  • Tier 3 EZ-Prime: Custom Solution

  • Booking: Clients can book maximum hours of tier criteria within a week if slots are available.

  • Unused Hours: Unused hours can be carried over to subsequent months and used in available slots.

  • Pause Option: Clients have the option to pause and resume usage of remaining hours.

  • Initial Consultation: The initial consultation call does not count towards the subscription hours. Subsequent feedback meetings will be counted against the subscription hours.

Payments and Billing

  • Payment: Payments for subscription plans and services must be made in advance.

  • Billing Cycle: Subscription plans are billed on a monthly basis.

  • Late Payment: Late payments may result in suspension or termination of services.

  • Credit Card Fraud: Any fraudulent activity related to credit card payments will be reported to the authorities. We reserve the right to terminate services immediately if fraudulent activity is detected.

Cancellations and Refunds

  • Cancellations: Clients may cancel their subscription plan at any time by providing written notice.

  • Refunds: No refunds will be issued for unused hours.

Client Responsibilities

  • Accurate Information: Clients must provide accurate and complete information for billing and service provision.

  • Timely Communication: Clients must respond to our communications promptly to ensure the smooth provision of services.

  • Time Tracking: Clients can monitor the hours used by the Ezease team through a time tracking application.

Intellectual Property

  • Ownership: All intellectual property rights in the designs and materials we create remain our property until full payment is received.

  • License: Upon full payment, clients are granted a non-exclusive, non-transferable license to use the designs for the specified purpose.

  • Agency Use: We reserve the right to use the work created for the client (including visuals, icons, animations, websites, etc.) for our own self-promotion or portfolio.

  • Case Studies: We may use the work created for clients in case studies to showcase our services and capabilities.

  • Client Exclusivity: If a client chooses to retain complete copyright and does not want us to showcase their work, they must pay a fee agreed upon by the agency. Upon payment, Ezease will not showcase any deliverables in our portfolio or for promotional purposes.

Confidentiality

  • Confidential Information: Both parties agree to keep confidential any sensitive information disclosed during the course of the project.

Limitation of Liability

  • No Warranty: We provide our services "as is" without any warranties of any kind.

  • Liability: Our liability for any claims arising out of or related to our services is limited to the amount paid by the client for the services.

Dispute Resolution

  • Governing Law: These Terms are governed by international law.

  • Resolution: Any disputes arising out of or related to these Terms shall be resolved through good faith negotiations.

Working Hours

  • Standard Hours: Our standard working hours are from 8:00 AM to 12:00 AM (+6 GMT) Monday to Friday.

  • Special Projects: Special projects may require weekend work or availability beyond standard working hours, which will be arranged as needed.

Amendments

  • Changes: We reserve the right to amend these Terms at any time. Clients will be notified of any changes in advance.

Acceptance

  • Agreement: By purchasing a subscription plan or placing an order, clients acknowledge that they have read, understood, and agreed to these Terms.
